TERMS & CONDITIONS

Effective date: 11-01-2026

1) Introduction
These Terms & Conditions (“Terms”) govern your use of https://www.expatadvisory.nl and any member portal features provided by EXPAT Advisory B.V. (“we”, “us”, “our”). By accessing or using the website or creating an account, you agree to these Terms.

2) Our services and scope (what we do)
We provide cross-border personal finance advisory, planning, and coordination support; designed to be practical, actionable, and tailored to your situation. Depending on the package you engage, this may include:

  • Intake review and structured discovery of your situation and goals
  • Personalized recommendations and prioritization (what to do first, what can wait, what to avoid)
  • Written deliverables (e.g., summaries, checklists, plans, routines, and frameworks)
  • Decision support (e.g., evaluating options like timing, cash-flow sequencing, account strategy)
  • Coordination support (e.g., helping you prepare questions and documentation for third-party professionals)

Our deliverables are intended to be used as “handoff-ready” guidance. You may share them with your licensed tax advisor, attorney, accountant, or other professionals as part of your execution process.

3) What we do NOT do (important boundaries)
To keep expectations clear:

  • We do not provide legal advice or legal representation.
  • We do not prepare, sign, or file tax returns or other statutory filings.
  • We do not act as your tax preparer or attorney.
  • We do not provide regulated investment management services, trade execution, custody of assets, or product sales.
  • We do not guarantee outcomes from third parties (e.g., tax authorities, banks, employers, government agencies).

Where a licensed professional is required (for example, tax filings or legal advice), you are responsible for engaging them. We can support you by organizing information, preparing questions, and helping you understand tradeoffs; but the licensed professional is responsible for formal determinations and filings.

4) No professional-client relationship until confirmed
Creating an account or submitting an intake does not create a professional-client relationship. A professional-client relationship begins only when:

  • you have been accepted for a specific engagement/package,
  • payment has been made (if required), and
  • we confirm the engagement scope.

5) Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must provide accurate information and keep it updated.

We may suspend or terminate accounts that violate these Terms or are used for abuse, fraud, or unlawful activity.

6) Intake, recommendations, and scheduling workflow
Our workflow may include:

  • You submit an intake.
  • We review and provide a recommended package.
  • Scheduling may be unlocked only after review and recommendation.
  • Where applicable, payment may be collected during booking via our scheduling/payment providers.

We may decline an engagement if it is outside our scope or capacity.

7) Fees, VAT, and third‑party costs
Unless stated otherwise:

  • Prices are shown in EUR.
  • VAT (BTW) may be added where applicable.
  • Third‑party costs (e.g., tax preparer fees, government fees, notary fees, translations, banking fees) are not included unless explicitly stated.

8) Rescheduling, cancellations, and no‑shows
Rescheduling and cancellation rules are set out in the scheduling tool confirmation and/or the engagement-specific terms. Repeated no-shows or late cancellations may result in forfeited sessions or termination of support.

9) Deliverables and timelines
Deliverables and timelines vary by package and depend on timely client cooperation (e.g., completing intake, providing clarifications). Any timeframes are estimates.

10) Tools and resources
Tools and resources in the portal may change over time. We do not guarantee uninterrupted access or that tools will be error-free. Tools are provided to support planning and decision-making and do not replace licensed professional services where those are required.

11) Intellectual property
All website content, templates, and materials we provide are our intellectual property (or licensed to us) unless otherwise stated. You may use deliverables for your personal use. You may not reproduce, resell, or distribute our materials without permission.

12) Confidentiality
We treat client communications as confidential in normal operations. We may disclose information if required by law, to enforce these Terms, or to protect our rights.

13) Limitation of liability
To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, consequential, special, or punitive damages.
  • Our total liability for any claim is limited to the amount you paid us for the specific service giving rise to the claim.

Nothing in these Terms limits liability where it cannot be limited under applicable law.

14) No guarantees
Your outcomes depend on many factors outside our control (e.g., government decisions, employer policies, bank requirements, tax authority interpretations, market movements). We do not guarantee specific outcomes.

15) Privacy
Our processing of personal data is described in our Privacy Policy.

16) Changes
We may update these Terms from time to time. Changes apply upon posting the updated Terms on the website.

17) Governing law and disputes
These Terms are governed by the laws of the Netherlands. Any disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer protection law provides otherwise.
